Live Performance Agreement

The Southcoast Artists Index Contract for Recording and Publishing Live Musical Performances

  1. Parties Involved
    • Recording Entity: South Coast Artists Index

  1. Purpose
    • Consent to record and publish live musical performances on the Recording Entity's YouTube channel, social media channels (e.g., Facebook, Instagram, TikTok), and website for the purpose of preserving the legacy of the recording artist.
  2. Grant of Rights
    • Recording Permission: The Performing Artist grants the Recording Entity permission to capture video and audio of their live performance.
    • Public Posting: The Performing Artist allows the Recording Entity to post the recorded performance to the public via previously agreed upon designated platforms.
  3. Metadata and ISRC Submission
    • Metadata Provision: The Performing Artist must provide complete song metadata, including title, artist, album, and other relevant information, including, but not limited to, Co-Writers, Musicians and Performing Rights Organization (ASCAP, BMI or SESAC).
    • ISRC Codes: The Performing Artist must provide International Standard Recording Codes (ISRC) for each song performed, if available.
  4. Co-Writer Information
    • Disclosure of Co-Writers: The Performing Artist must disclose any co-writers of the songs performed.
    • Consent from Co-Writers: It is the responsibility of the Performing Artist to obtain necessary permissions from co-writers for the recording and public posting of the performance.
  5. Compensation and Royalties
    • Payment Terms: Any express agreed-upon compensation, in writing, for the performance and recording.
    • Royalty Terms: If the ISRC code is provided, the Performing Artist will be compensated by their DSP (Digital Service Provider-CD Baby, DistoKid, TuneCore, United Masters, etc.) or record label according to their existing royalties agreement. The Southcoast Artists Index is not responsible to for any artists compensation from their channel monetization.
  6. Usage and Promotion
    • Marketing Use: The Recording Entity may use clips or images from the performance for promotional purposes.
    • Attribution: The Performing Artist will be properly credited in all postings and on each and every platform where the content is uploaded.
  7. Term and Termination
    • Duration of Rights: The Southcoast Artists Index is allowed to use and distribute this content in perpetuity. (Expect push back on this. If the are currently unsigned and subsequently sign with a label, said label may ask for a “take-down” so as to start fresh and control its artist’s social media footprint)
  8. Miscellaneous
    • Governing Law: The laws governing this agreement.
      • Copyright Law: Ensures that the rights of songwriters, composers, and performers are protected, including permissions for recording and public distribution.
      • Contract Law: Regulates the terms and enforcement of agreements between parties.
      • Performance Rights Organizations (PROs): Such as ASCAP, BMI, and SESAC in the United States, which manage the rights and royalties for public performances.
      • Local and State Laws: Can also apply, particularly regarding the legality of live recordings, use of public spaces, and noise ordinances.
