As described below: We use your personal and freely contributed information as this Privacy Use & Policy describes. No matter where you are, where you live, or what your citizenship is, we provide a high standard of privacy protection to all our users around the world, regardless of their country of origin or location.
Partners & Collaborators – [as of 07-01-21] We are working in collaboration with the New Bedford Whaling Museum’s Common Ground project to transcribe, all of our podcasts episodes from the first to the most current, digitize them, and archive them in the Museum’s database in perpetuity. As such, all the articles of this Use & Privacy Policy also pertain to them as our agent, representative, and assigns in the course and function of our operation for the duration of our (open-ended) collaboration.
Specifically, this collaboration includes all communication and correspondence, both electronic and conventional as follows:

Information Collection and Use – What personal data we collect and why we collect it. While using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. What is personally identifiable information? The Artists Index collects information directly from you for your registration, payment, transactions, and user profile. We also automatically collect from you your usage information, cookies, and similar technologies, and device information, subject, where necessary, to your consent.
The Artists Index may also collect User Personal Information (personally identifiable) from third parties. We only collect the minimum amount of personal information necessary from you, unless you choose to provide more. - Comments – When visitors leave comments on the site, we collect the data shown in the comments form, and the visitor’s IP address and browser user agent string to help spam detection. An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. - Media – If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Physical Contributions/Gifts
Any information, whether in digital/electronic form or media (text, documents, image, video, and audio files) or, physical documentation (ephemera, memorabilia, primary source documents, photos, film, audiotape, or any other non-digital media such as records) freely provided by any visitor/user/participant of this website in person, by mail, or by other conveyance is done so without compensation. The donor has the option to request that they are credited/cited (recognized), when/if the material(s) are used. The donation must be accompanied by a letter from the donor/donating party stating that they are freely donating the items as listed in the accompanying signed letter.
It may be possible, in certain circumstances, for the donor to take a tax deduction for the donation of their items or collection to The Artists Index. As such, we suggest they speak with their tax accountant, attorney, and/or certified appraiser first since we are not qualified to appraise the monetary value of any item(s) or collection(s) that the donor is considering donating.
Copyright
Copyright assignment is complex. In some cases, the copyright ownership of donated materials, ephemera, or memorabilia must be clarified. Please note, copyright belongs to the creator of art, writings, and other original material (such as photos and music). It can and may be legally transferred to heirs or others. Additionally, ownership of copyright is separate from ownership of the physical item being donated. In some cases, we may have to ask donors to donate the physical items as well as any related/attached copyright the donor might own in order to allow our principles, employees, interns, sub-contractors, and others, to use portions of the materials in the performance of their work.
The terms of U.S. Copyright Law allow us to provide copies of the donated items in our possession/collections for scholarly research use. Under the “fair use” exemption, the law permits us, our assignees, agents, and heirs in perpetuity, to publish portions of an item under copyright. The permission to publish or quote extensively from the material must still be obtained from the copyright holder. For more information please refer to www.copyright.gov or consult an attorney.
Log Data or Data Logging – Like many site operators, we collect information that your browser sends whenever you visit our Site. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
